Can I be arrested for DWI if I wasn’t drinking any alcohol?
Yes. In Texas, you can be arrested and charged with Driving While Intoxicated (DWI) due to intoxication by drugs - including both illegal drugs and legally-prescribed medication. These cases are prosecuted in criminal courts just like alcohol-related DWI cases are. However, because there is no “legal limit” for DWI with Drugs like the 0.08 BAC standard for DWI with alcohol, proving actual intoxication can be challenging for the prosecution.
