Motion for New Trial

If you were recently convicted by a judge or jury in trial court, but feel that you were not given a fair trial, you may be able to overturn the conviction through a motion for new trial filed with the trial court. Direct Appeal

If you were found guilty by a judge or jury, you may be able to fight and overturn the conviction through a direct appeal to one of the 14 Courts of Appeal in Texas. Matt has successfully argued in front of the Texas Court of Criminal Appeals, the highest criminal court in Texas. In 2018, he traveled to Austin, Texas to present oral argument in front of the Texas Court of Criminal Appeals and won an unanimous reversal in Ex parte Garrels. On remand, Matt convinced the Ninth Court of Appeals in Beaumont, Texas to reverse its prior decision and reversed the trial court’s judgment. The Ninth Court of Appeals opinion is available to read here. After appeal, the State was barred from retrial based on double jeopardy.

Writ of Habeas Corpus

If you have been convicted of a crime and were unsuccessful on appeal, you may still be entitled to relief by filing an Application for Writ of Habeas Corpus. Often, Writs of Habeas Corpus deal with claims of “ineffective assistance of counsel” - essentially an argument that your trial attorney’s representation fell below an objective standard of reasonableness and the attorney’s performance prejudiced you in some way.
